Who can sue for Wrongful Death?

In Texas, only the surviving spouse, children and parents of the decedent can bring an action for wrongful death.  If none of these individuals has begun an action within three calendar months after the decedent's death, then the executor of the decedent's estate must bring the action.  Therefore, brothers, sisters, grandparents, cousins, aunts, uncles, step-parents and step-children cannot bring an action for wrongful death.
